43 Challenge Guidelines

Policies:

  • NPCF is seeking innovative solutions that achieve significant advances addressing pediatric cancer treatment & therapies.
  • The NPCF prefers to narrow/limit the research proposals to the cancers that need the most effort to increase survival rates
  • This Challenge is open only to US adult citizens (18 years+ age) & US licensed/registered/incorporated institutions with lawful permanent residence within the US.
  • Multi-disciplinary / joint teams from US based public/private academic, science, healthcare, corporate, and community health/clinical trial research institutions are highly encouraged to apply
  • NPCF staff and board are not eligible 
  • The NPCF has overall responsibility for governance of this award. The recipient institution/organization is a shared responsibility of the awardee’s program director/principal investigator (PD/PI), who leads the scientific aspects of the award, and the awardee’s authorized organization representative (AOR) and research/project administrator, who leds the administrative aspects of the award.
  • Teams must designate one individual member as the “Team Leader” for contact and Contest administrative purposes. The Team Leader will be responsible for submitting the Entry on behalf of the Team. In the event an individual on a Team is disqualified, the Team the individual belongs to, and the Entry submitted by the Team will be disqualified. 
  • Business Entities: Business Entity Participants must enter the Contest on behalf of their legal business organizations to develop and submit a single Entry. An Entry submitted by a Business Entity Participant must designate one individual member as the “Business Team Leader” for contact and Contest administrative purposes. The Business Team Leader will be responsible for submitting the Entry on behalf of the Business Entity. Any individual who is employed by a Business Entity Participant may not submit an Entry in his or her individual capacity (i.e., as an Individual Participant, or as part of a Team).
  • Participants may only submit one Entry as the lead investigator/team leader. Participants are eligible to participate on other/multiple projects as team members.
  • Participants are responsible for any costs or expenses associated with preparing and submitting an Entry.
  • All Entries suspected of violating intellectual property rights, or any local or country law(s) will be ineligible. Participants assume all risk of damaged, lost, late, incomplete, invalid, incorrect, or misdirected Entries.
  • All Entries (and related information) shall be deemed collected and judged in the United States of America. All Entries must be submitted in English.
  • Each Participant agrees that NPCF will have the right, but not the obligation, in its sole discretion to contact any Participant regarding a possible transaction or other business relationship with NPCF to commercially pursue a submitted idea.
  • Each Initial letter of intent along with the other information requested of Participant during the registration process, may be reviewed by NPCF and/or one or more judges selected by NPCF (collectively, the “Review Panel”), to confirm if the submission meets the eligibility criteria for the Challenge and is deemed a desired research interest for NPCF to support. In NPCF’s discretion, NPCF may engage third-party subject matter experts and judges to serve on the review panel and/or assist with the review of Entries and selection of winner(s).
  • If NPCF leadership (with input from the Review Panel, as appropriate) determines that any Submission does not or may not meet the eligibility criteria for the Challenge, NPCF may (a) disqualify the Entry, or (b) request that the Participant submit a revised, clarified description of the Entry, for further consideration by NPCF.   
  • To enter the final selection process each nominee selected from Round Two will be notified by email and be required to submit the “Full Grant Application”.
  • Award winners agree that the information, ideas, and materials provided to NPCF in connection with the selection process and any other information, ideas or other materials otherwise provided to NPCF in connection with the Challenge, may be publicly disclosed by NPCF or its agents, and used for NPCF’s marketing and public relations activities, in NPCF’s sole discretion.
  • The Selection Panel may select one or more finalists (*). The Selection Panel will make its selections based on the merits/content of the Entries using their best judgement and/or as outlined in these Terms and Conditions. 
    • * NPCF reserves the right to modify.
  • Finalists will be notified of their selection prior to September 1, 2022 (prior to any public announcement) in order to confirm acceptance and agreement.

 

Key Terms:

  • Upon selection as a finalist, the NPCF will provide a “notice of award” agreement. The NPCF 43 Challenge notice of award (NOA) agreement will serve as the legal document establishing the relationship between the NPCF and the recipient and will include terms and conditions applicable to the mutually agreed upon research.
  • The notice of award (NOA) agreement documents the approval of a project period and expresses the NPCF intent to provide continued financial support for the project. Projected levels of funding are contingent on satisfactory progress, and the continued best interest of the NPCF. Award projects are programmatically approved for support in their entirely but are funded in increments called funding segments.
  • An initial NOA will be issued covering the first 12 months of the project. The NOA may thereafter be renewed on an annual basis, subject to successful annual review and progress.
  • NPCF reserves the right to cease/terminate future funding without liability upon the occurrence of any circumstance beyond the control of either party such as acts of God, war, terrorism, disaster, strikes, government regulation, civil disorder or similar.
  • The NPCF will not approve any budget with indirect facility/administrative costs above 15%.
  • It the NPCF decides to terminate an award, the termination of the award will be considered a unilateral change and the awardee will not have the right to appeal. An awardee may also partially or totally terminate the award based on termination request to the NPCF. The NPCF reserves the option to terminate the award for cause.
  • The NPCF reserves the right to identify and administratively recover funds paid to an awardee at any time during the life cycle of the award.
  • The NPCF intends to uphold high ethical, health, and safety standards in both the conduct of the research it funds and the expenditure of funds by its awardees.
  • The NOA with awardee signature certifies that the organization complies, or intends to comply, with all applicable laws, policies, certifications, and assurances applicable to recipient of NPCF funds and applicable research practices as required by federal/state/local law. Applicants and awardees should familiarize themselves with the FDA regulations related to good clinical practice and clinical trials, and requirements of Title VIII, Sec. 801 of public law 110-85 (FDA Amendments Act of 2007), with respect to registration and results and compliance for certain clinical studies.
  • Proprietary or Privileged Information Patentable ideas, trade secrets, privileged or confidential commercial or financial information, disclosure of which may harm the proposer, should be included in proposals only when such information is necessary to convey an understanding of the proposed project. Such information must be clearly marked in the proposal and be appropriately labeled with a legend such as, “The following is (proprietary or confidential) information that (name of proposing organization) requests that it not be released to persons outside the NPCF, except for purposes of review and evaluation.” While NPCF will make every effort to prevent unauthorized access to such material, the NPCF is not responsible or in any way liable for the release of such material.
  • NPCF funding will/may not be used to support human fetal tissue research.
  • If NPCF selects a current Sunshine Project member as an awardee, such award is subject to requirements / agreements related to said Sunshine Project guidelines/agreements.
