Participant Liability Release and Hold Harmless Agreement For individuals who are eighteen (18) YEARS OF AGE OR OLDER (An Adult) BY SIGNING THIS FORM AS A PERSON 18 YEARS OF AGE OR OLDER (An Adult), YOU HEREBY AGREE TO WAIVE, HOLD HARMLESS, AND RELEASE YOUR RIGHTS TO MAKE CLAIMS AGAINST CERTAIN PEOPLE AND ENTITIES IF YOU PARTICIPATE IN 2025 Fishing Funds The Cure San Juan (June 5-7, 2025). Throughout this document, the name “Released Parties” shall include all the following: The National Pediatric Cancer Foundation, Inc.; its officers; directors; members; agents; employees of the preceding parties; and event sponsors, their representatives, and successors (hereinafter collectively “Releasees.”) I know, understand, and agree that participating in a fishing tournament and in the 2025 Fishing Funds The Cure San Juan (June 5-7, 2025) (the “Event”) particularly, is a hazardous activity, including water sports and watercraft activities, which could cause injury or death. I will not enter, nor will I participate in the Event unless I am medically able and properly trained. By my signature, I certify that: I am medically able to participate in this Event, I am in good health, and I am properly trained. I will abide by any decision of an Event official relative to any aspect of my participation in this Event, including the right of any official to deny or suspend my participation for any reason whatsoever. I know, understand, and agree that the Releasees have no responsibility to have insurance for me for losses, injuries, or damages that I may suffer during the Event. Insurance for me is my responsibility, or the responsibility of someone other than the Released Parties. Even though the Releasees or someone else may be careless, negligent, or do something intentional or unintentional to hurt or injure me during the Event I know, understand, and agree that I will never hold the Releasees liable regardless of the cause of the injury or harm. If I am injured, need medical treatment, or even die during the Event, I agree that the Released Parties will not be held liable for any damages of any kind. I ADMIT AND AGREE THAT THE RELEASEES HAVE NO DUTY OF ANY KIND TO MAKE THE EVENT SAFE FOR ME; NO DUTY TO TAKE ANY PRECAUTIONS ON MY BEHALF; AND NO DUTY TO PROTECT ME FROM DAMAGE, LOSS, OR INJURY. I ADMIT AND AGREE THAT EVEN THOUGH THERE WILL BE VEHICLES TRAVELING ON THE SAME ROAD AND AT THE SAME TIME THAT I WILL BE RUNNING ON THE ROAD, RELEASEES HAVE NO RESPONSIBILITY TO PROTECT ME FROM THE OPERATION OF THOSE VEHICLES EVEN WHEN THOSE VEHICLES ARE OPERATED IN A NEGLIGENT, GROSSLY NEGLIGENT, OR RECKLESS MANNER. I ASSUME ALL RISKS ASSOCIATED WITH PARTICIPATING IN THIS EVENT, including but not limited to: falls, drowning, boating accidents, contact with other participants, the effects of the weather, including high heat and/or humidity and inclement weather, traffic, conditions of the boats and all waterways, conditions of: fishing equipment, docks, marinas, steps, ladders, the areas in and around the marina, and all such risks being known and appreciated by me. I understand that I will abide by all tournament rules, the rules of the captain of the boat assigned, and other event rules as published by the Released Parties. Knowing these facts and in good and valuable consideration of the acceptance of my entry, and in advance of the Event: 1. I COMPLETELY AND FOREVER RELEASE AND AGREE TO HOLD HARMLESS the Released Parties, collectively the Releasees, their representatives and successors, from all claims, liability, loss, damage, attorney fees, costs, claims and/or causes of action of any kind whatsoever, including but not limited to physical and emotional injury or death, caused in whole or in part by anyone’s negligence, gross negligence, carelessness, recklessness, or intentional misconduct, and arising out of my participation in this Event. 2. This release and agreement to hold harmless, includes all claims, liability, loss, damage, attorney fees, costs, claims and/or causes of action of any kind whatsoever - including but not limited to physical and emotional injury or death - against the Releasees regardless of who or what is at fault. 3. I COMPLETELY AND FOREVER RELEASE AND HOLD HARMLESS the Releasees even though all or some of the claims and liability may arise in whole or in part from the negligence, gross negligence, carelessness, recklessness, or intentional misconduct on the part of the Releasees. BY INDICATING YOUR ACCEPTANCE OF THIS LIABILITY RELEASE AND HOLD HARMLESS AGREEMENT, YOU ARE AFFIRMING THAT YOU HAVE READ AND UNDERSTAND THIS WAIVER ABOVE AND FULLY UNDERSTAND ITS TERMS. YOU UNDERSTAND THAT YOU ARE GIVING UP SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE. YOU ACKNOWLEDGE THAT YOU ARE SIGNING THE RELEASE AND HOLD HARMLESS AGREEMENT FREELY AND VOLUNTARILY AND INTEND BY YOUR ACCEPTANCE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW. Media Release – Appearance Agreement I understand that as participant and/ or a spectator at the Event that I may be included in recordings, streaming, videotapes, photographs, DVDs, podcasts and videocasts taken during the Event. Therefore, without reservation or limitations, I, on my own behalf, hereby assign, transfer and grant to Releasees and their successors, assignees, licensees, sponsors, any television networks, and all other commercial exhibitors the exclusive right to photograph and / or videotape me and to utilize such videotapes and photographs and my name, face likeness, voice and appearance as a part of the Event or in any other media now in existence or hereafter developed, in advertising and promoting the Event, in advertising and promoting similar future events or in advertising and promotions relating to Releasees without reservations and limitations. I further understand that neither the National Pediatric Cancer Foundation, Inc. nor any third party is under any obligation to exercise any of the foregoing rights, licenses and privileges herein granted. I waive any right to inspect or approve any materials related thereto.
